These Terms & Conditions (“Terms,” “Terms and Conditions,” or “Agreement”) govern your access to and use of www.ticketswale.com (the “Website”) and the purchase or use of air-ticketing and travel-related services provided by TicketsWale (“TicketsWale,” “we,” “us,” or “our”).

TicketsWale provides travel and air-ticketing services, including assistance with finding, quoting, reserving, and purchasing airline tickets, particularly for travel between Canada and India.

3. ACCEPTANCE OF THESE TERMS

By using the Website or purchasing Services, you agree to:

  • Any additional terms communicated to you before or during your transaction.

Where a specific booking condition conflicts with these general Terms, the specific booking condition or applicable mandatory law may prevail to the extent of the conflict.


4. NATURE OF TICKETSWale’S SERVICES

TicketsWale operates as a travel and air-ticketing service provider and may act as an intermediary between customers and airlines, consolidators, reservation systems, global distribution systems, payment providers, and other travel suppliers.

TicketsWale does not generally operate the aircraft or control the airline’s operational decisions.

The airline remains responsible for operating its flights and for obligations imposed upon it by applicable law, its tariff, and its conditions of carriage.

TicketsWale’s role may include:

  • Searching available fares;
  • Providing fare quotations;
  • Facilitating reservations;
  • Issuing tickets;
  • Processing payments;
  • Assisting with changes and cancellations;
  • Assisting with refund requests; and
  • Providing customer support.

5. ELIGIBILITY TO USE THE WEBSITE

By using the Website, you represent that:

  • You are legally capable of entering into a binding agreement;
  • The information you provide is accurate and complete;
  • You have authority to make a booking for yourself or the passengers you represent;
  • You will use the Website only for lawful purposes; and
  • You will comply with applicable laws, regulations, airline rules, and these Terms.

If you make a booking on behalf of another passenger, you represent that you are authorized to provide the information and accept these Terms on behalf of that passenger to the extent permitted by law.


6. WEBSITE USE

You may use the Website only for legitimate personal or authorized business purposes.

You must not:

  • Use the Website for fraudulent purposes;
  • Provide false or misleading information;
  • Attempt to obtain tickets using stolen payment information;
  • Interfere with Website security;
  • Introduce malicious software;
  • Attempt unauthorized access to our systems;
  • Scrape or systematically extract Website data without authorization;
  • Circumvent Website security or access controls;
  • Manipulate fares or booking systems;
  • Make speculative or fraudulent reservations;
  • Use automated systems to interfere with Website operations; or
  • Use the Website in violation of applicable law.

TicketsWale reserves the right to suspend or restrict access where we reasonably believe the Website is being misused.


7. AIRFARES AND PRICING

Airfares displayed or quoted through TicketsWale may change until the applicable booking is confirmed and the ticket is issued.

Prices may vary based on:

  • Airline inventory;
  • Fare class;
  • Travel dates;
  • Passenger type;
  • Routing;
  • Availability;
  • Taxes;
  • Government charges;
  • Airport charges;
  • Currency fluctuations;
  • Airline pricing;
  • Promotional availability; and

A fare displayed on the Website does not necessarily constitute a guaranteed offer to sell a ticket at that price.

The final price will be confirmed during the booking process.


8. DISCOUNTED FARES

If a ticket has already been issued, any corrective action will be subject to applicable law, airline rules, and the circumstances of the transaction.


10. QUOTATIONS AND FARE HOLDS

Unless expressly stated in writing, a fare quotation does not guarantee that the quoted fare will remain available.

A quotation may expire after the period specified by TicketsWale.

A fare is generally secured only when the applicable reservation has been confirmed and the ticket has been issued, subject to the airline’s rules.

If TicketsWale specifically confirms a fare hold or price guarantee, the terms of that hold will apply.


11. BOOKING CONFIRMATION

A booking request or payment does not necessarily mean that a ticket has been successfully issued.

Customers should wait for the final booking confirmation and ticket number.

A confirmed ticket generally includes information such as:

  • Passenger name;
  • Booking reference/PNR;
  • Flight itinerary;
  • Airline;
  • Travel dates;
  • Ticket number; and
  • Other applicable booking details.

If you do not receive a ticket confirmation, contact TicketsWale immediately.


12. PASSENGER INFORMATION

Customers are responsible for providing accurate passenger information.

Information may include:

  • Full legal name;
  • Date of birth;
  • Gender or title where required;
  • Passport information;
  • Nationality;
  • Contact details;
  • Frequent-flyer information; and
  • Other information required by the airline.

Passenger names should match the applicable passport or travel document.

Incorrect information may result in:

  • Name-correction charges;
  • Ticket reissue fees;
  • Fare differences;
  • Denied boarding;
  • Cancellation of a booking; or
  • Other airline-imposed consequences.

TicketsWale is not responsible for losses resulting from incorrect information supplied by a customer, except where liability cannot legally be excluded.


13. BOOKINGS FOR OTHER PASSENGERS

If you make a booking for another person, you are responsible for providing accurate information and ensuring that the passenger receives relevant booking information.

You should ensure that the passenger is aware of:

  • Flight details;
  • Fare conditions;
  • Cancellation rules;
  • Baggage allowances;
  • Travel-document requirements; and
  • Other applicable conditions.

14. PAYMENT

Payment must be made using an accepted payment method.

TicketsWale may use third-party payment processors or financial institutions to process transactions.

You represent that:

  • You are authorized to use the payment method;
  • The information supplied is accurate;
  • The transaction is legitimate; and
  • You will not use a payment method without authorization.

TicketsWale may delay or decline a transaction where we reasonably suspect fraud, unauthorized use, or payment irregularities.


15. PAYMENT AUTHORIZATION AND TICKET ISSUANCE

Payment authorization does not always mean that a ticket has been issued.

A payment may require additional verification before ticket issuance.

TicketsWale reserves the right to request additional information reasonably necessary to verify a transaction.

If payment cannot be successfully verified or completed, TicketsWale may cancel the booking request.


16. CREDIT CARDS AND PAYMENT FRAUD

Customers must not use payment cards or accounts without authorization.

TicketsWale may conduct reasonable fraud-prevention checks.

Where a transaction is suspected to be fraudulent, TicketsWale may:

  • Delay ticket issuance;
  • Request identity or payment verification;
  • Cancel a pending booking;
  • Refuse a transaction;
  • Contact the payment provider; or
  • Report suspected fraud to appropriate authorities where legally permitted or required.

17. CURRENCY

TicketsWale may accept or display payments in Canadian dollars, Indian rupees, or other currencies.

The final amount charged may differ from an estimated currency conversion because of:

  • Exchange-rate fluctuations;
  • Payment-provider conversion rates;
  • Bank charges;
  • Card-issuer fees; or
  • Other applicable fees.

TicketsWale is not responsible for foreign-exchange charges imposed by a customer’s bank or payment provider.


18. AIRLINE FARE RULES

Every airline ticket is subject to fare rules.

Fare rules may specify:

  • Whether a ticket is refundable;
  • Cancellation penalties;
  • Change fees;
  • Fare differences;
  • No-show penalties;
  • Advance-purchase requirements;
  • Minimum stay;
  • Maximum stay;
  • Travel-date restrictions;
  • Ticket validity;
  • Name-change restrictions; and
  • Other conditions.

The applicable fare rules form part of the customer’s booking agreement.

Where an airline’s fare rules impose restrictions, TicketsWale cannot waive those restrictions unless the airline authorizes the change.


19. AIRLINE CONDITIONS OF CARRIAGE

Airline tickets are also subject to the operating airline’s conditions of carriage and applicable tariff.

These may contain provisions relating to:

  • Reservations;
  • Ticket validity;
  • Check-in;
  • Baggage;
  • Delays;
  • Cancellations;
  • Denied boarding;
  • Passenger conduct;
  • Refusal to transport;
  • Liability;
  • Refunds;
  • Re-routing;
  • Claims; and
  • Other matters.

The Canadian Transportation Agency explains that airline tariffs contain the terms and conditions governing matters such as ticket reservations, cancellations, refunds, re-routing, failure to operate as scheduled, and liability.

Customers should review the applicable airline’s conditions before travelling.


20. FLIGHT SCHEDULES

Airlines may change flight schedules after a ticket has been issued.

Changes may include:

  • Departure time;
  • Arrival time;
  • Flight number;
  • Aircraft;
  • Connection;
  • Route;
  • Airport; or
  • Other itinerary details.

TicketsWale will communicate material changes to customers where the information is provided to us and where we have appropriate contact information.

Customers should also monitor communications from the airline.


21. FLIGHT CANCELLATIONS AND DELAYS

TicketsWale does not control airline operations.

If an airline cancels or delays a flight, the available options may include:

  • Rebooking;
  • Refund;
  • Travel credit;
  • Alternative transportation; or
  • Other remedies.

The applicable option depends on the airline’s rules, the reason for the disruption, and applicable law.

For flights to, from, or within Canada, applicable passengers may have rights under Canada’s Air Passenger Protection Regulations (“APPR”). The APPR includes requirements relating to communication, rebooking, refunds, treatment during disruptions, and compensation in specified circumstances.

Nothing in these Terms limits mandatory rights available to passengers under applicable law.


22. AIRLINE-INITIATED REFUNDS

Where a refund is required under applicable airline rules or law, TicketsWale will assist in processing the refund where TicketsWale is responsible for or able to facilitate the transaction.

Under applicable Canadian APPR provisions, airlines may be required in specified circumstances to provide passengers with a refund or rebooking when a cancellation or lengthy delay prevents completion of the itinerary within a reasonable time.

Customers should contact TicketsWale promptly when seeking assistance with an airline-initiated refund.


23. CUSTOMER-REQUESTED CANCELLATIONS

Customer-requested cancellations are governed by the applicable fare rules.

Depending on the ticket, cancellation may result in:

  • Full refund;
  • Partial refund;
  • Airline penalty;
  • TicketsWale service fee;
  • Travel credit;
  • Fare loss; or
  • No refund.

24. CHANGES AND REBOOKING

Ticket changes are subject to the applicable airline fare rules.

Changes may require payment of:

  • Airline change fees;
  • Fare differences;
  • Taxes;
  • TicketsWale service or processing fees; or
  • Other applicable charges.

TicketsWale cannot guarantee that a requested flight, seat, fare, or routing will remain available while a change request is being processed.


25. NO-SHOW

A passenger who does not travel on a booked flight without making an appropriate cancellation or change may be considered a No-Show.

A no-show may result in:

  • Loss of ticket value;
  • Cancellation of remaining segments;
  • Additional fees;
  • Loss of return or onward reservations; or
  • Other airline penalties.

Passengers who know they cannot travel should contact TicketsWale before the scheduled departure time whenever possible.


26. PARTIALLY USED TICKETS

If a ticket has been partially used, the remaining ticket value may be calculated according to the airline’s fare rules.

Unused portions are not automatically refundable.

The airline may recalculate the fare based on the journey already completed.


27. REFUNDS

Refund eligibility and refund amounts are governed by:

  • Applicable fare rules;
  • Airline policies;
  • The circumstances of the cancellation;
  • Applicable law;
  • Amounts already used;
  • Applicable penalties; and
  • TicketsWale processing or service fees, where applicable and disclosed.

28. REFUND PROCESSING

Where TicketsWale is responsible for processing a refund, we will submit or process the request according to the applicable airline or supplier procedures.

Refund timing may depend on:

  • Airline processing;
  • Payment processor;
  • Bank or card issuer;
  • Ticket type;
  • Refund authorization;
  • Government or regulatory requirements; and
  • Other factors.

Where a refund is legally required to be processed within a prescribed period, TicketsWale will comply with the applicable requirement.

The Canadian APPR, for example, requires airlines to provide certain qualifying refunds within 30 days.


29. TRAVEL CREDITS AND VOUCHERS

An airline may offer a travel credit or voucher instead of or in addition to a refund where permitted.

Travel credits may be subject to:

  • Expiration dates;
  • Name restrictions;
  • Route restrictions;
  • Transfer restrictions;
  • Fare restrictions; and

30. BAGGAGE

Customers are responsible for reviewing baggage allowances before travelling.

Additional baggage may incur separate charges.

TicketsWale is not responsible for baggage loss, damage, delay, or airline-imposed baggage charges, except to the extent required by applicable law.

For baggage disputes, customers may need to contact the operating airline directly.


31. SEAT SELECTION

Seat requests are subject to airline availability.

TicketsWale does not guarantee a specific seat unless the airline has confirmed the seat assignment.

Airlines may change seat assignments for operational, aircraft, safety, or other reasons.

Paid seat-selection fees may be subject to separate airline refund rules.


32. SPECIAL SERVICES

Requests for services such as:

  • Wheelchair assistance;
  • Special meals;
  • Unaccompanied-minor services;
  • Medical assistance;
  • Infant services;
  • Mobility assistance; or
  • Other special services

must generally be requested in advance and are subject to airline policies and availability.

TicketsWale can assist with submitting requests but cannot guarantee that an airline will approve or provide a particular service.


33. TRAVEL DOCUMENTS

Customers are solely responsible for obtaining all documents necessary for travel.

These may include:

  • Passport;
  • Visa;
  • Transit visa;
  • Residence permit;
  • Electronic travel authorization;
  • Entry permit;
  • Health documentation; and
  • Other required documents.

TicketsWale does not guarantee that a passenger will be permitted to enter or transit through a country.

Customers should verify requirements with the relevant government, embassy, consulate, immigration authority, or airline.


34. VISA REFUSAL

A visa refusal does not automatically entitle a customer to a ticket refund.

Any refund or cancellation will be subject to the applicable fare rules and law.

Customers should verify their eligibility and visa requirements before purchasing a ticket.


35. IMMIGRATION AND BORDER CONTROL

Airlines and government authorities may refuse boarding, transit, or entry based on applicable laws and regulations.

TicketsWale has no authority over immigration or border-control decisions.

TicketsWale is not responsible for a passenger’s inability to enter or transit through a country where the passenger does not meet applicable requirements, except where responsibility cannot legally be excluded.


36. CODESHARE AND INTERLINE BOOKINGS

A booking may include flights operated by multiple airlines.

The airline shown on the ticket may be different from the airline physically operating a particular flight.

Different airlines may have different rules regarding:

  • Baggage;
  • Check-in;
  • Seats;
  • Special services;
  • Schedule changes;
  • Boarding; and
  • Other operational matters.

Customers should review the operating-carrier information before travelling.


37. THIRD-PARTY SUPPLIERS

TicketsWale may use third-party providers to deliver certain aspects of its Services, including:

  • Airlines;
  • Consolidators;
  • Global distribution systems;
  • Reservation platforms;
  • Payment processors;
  • Technology providers;
  • Communication providers; and
  • Other travel suppliers.

Third-party services may be subject to their own terms and conditions.

TicketsWale is not responsible for matters outside its reasonable control arising from a third-party provider.


38. WEBSITE CONTENT

We make reasonable efforts to ensure that information on the Website is accurate and current.

However, we do not guarantee that Website content will always be:

  • Accurate;

  • Error-free;
  • Available; or
  • Suitable for every customer’s circumstances.

Prices, schedules, offers, availability, and other information may change without notice.


39. INTELLECTUAL PROPERTY

  • Logos;
  • Text;
  • Graphics;
  • Images;
  • Videos;
  • Designs;
  • Software;
  • Layout;
  • Trademarks; and
  • Other materials

is owned by or licensed to TicketsWale unless otherwise stated.

You may not reproduce, distribute, modify, publish, transmit, sell, or commercially exploit Website content without prior written permission, except where permitted by applicable law.


40. CUSTOMER REVIEWS AND CONTENT

If you submit a review, testimonial, comment, photograph, or other content to TicketsWale, you represent that:

  • It does not infringe another person’s rights;

TicketsWale may cancel transactions and take appropriate action where prohibited activity is suspected.


45. CHARGEBACKS AND PAYMENT DISPUTES

Customers are encouraged to contact TicketsWale before initiating a payment dispute where the matter can reasonably be resolved directly.

If a chargeback is initiated, TicketsWale may provide relevant transaction records, booking information, ticket records, correspondence, cancellation records, and other documentation to the payment processor or financial institution.

Nothing in this section limits any rights available to customers under applicable law.


46. FRAUD PREVENTION

TicketsWale may use reasonable security and fraud-prevention measures.

Where a transaction is identified as potentially fraudulent, TicketsWale may:

  • Request additional verification;
  • Delay ticket issuance;
  • Cancel a transaction;
  • Refuse a payment;
  • Contact the payment provider; or
  • Take other lawful measures.

47. FORCE MAJEURE

TicketsWale will not be responsible for failure or delay in performing its obligations where caused by circumstances beyond its reasonable control.

Such circumstances may include:

  • Natural disasters;
  • Severe weather;
  • War;
  • Terrorism or security threats;
  • Government actions;
  • Pandemics or public-health emergencies;
  • Strikes;
  • Labour disruptions;
  • Airport closures;
  • Airline system failures;
  • Telecommunications failures;

  • Cybersecurity incidents;
  • Payment-system failures; or
  • Other events beyond reasonable control.

This provision does not exclude any mandatory legal rights or obligations.


48. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, TicketsWale will not be liable for losses arising from circumstances outside our reasonable control, including:

  • Airline delays;
  • Airline cancellations;
  • Missed connections;
  • Baggage loss or damage;
  • Denied boarding;
  • Visa refusal;
  • Immigration decisions;
  • Government restrictions;
  • Weather;
  • Airport closures;
  • Airline operational changes;
  • Third-party service failures;
  • Payment-provider failures;
  • Website outages; or
  • Other circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.


49. NO GUARANTEE OF TRAVEL OUTCOME

TicketsWale does not guarantee:

  • That a specific fare will remain available;
  • That a particular flight will operate;
  • That a flight will operate on schedule;
  • That a passenger will obtain a visa;
  • That a passenger will be permitted to enter a country;
  • That a passenger will be accepted for boarding;
  • That baggage will arrive without delay or damage;
  • That a requested seat will remain assigned; or
  • That a particular travel outcome will occur.

50. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless TicketsWale Pvt. Ltd., its directors, officers, employees, agents, and service providers from claims, losses, liabilities, costs, and expenses arising from your:

  • Violation of these Terms;
  • Fraudulent or unlawful use of the Website;
  • Misuse of the Services;
  • Provision of false or inaccurate information;
  • Unauthorized use of another person’s payment method;
  • Violation of third-party rights; or
  • Breach of applicable law.

This provision does not apply to the extent that the claim arises from TicketsWale’s own liability that cannot legally be excluded.


51. TERMINATION OR SUSPENSION

TicketsWale may suspend or terminate your access to the Website or Services where we reasonably believe that:

  • You have violated these Terms;
  • Fraudulent activity has occurred;
  • Payment has not been authorized;
  • You have misused the Website;
  • Your activity creates a security risk; or
  • Suspension is required by law or a third-party supplier.

Termination does not affect rights or obligations that arose before termination.

53. AIR PASSENGER COMPLAINTS

For issues that fall directly under an airline’s legal obligations, customers may also have the right to pursue a complaint against the airline.

The Canadian Transportation Agency provides dispute-resolution and complaint mechanisms for qualifying air-travel issues.

Customers should generally first attempt to resolve the matter with the airline or relevant service provider before escalating a complaint, where applicable.

Nothing in these Terms prevents a customer from exercising rights available under applicable law.


54. GOVERNING LAW

These Terms shall be interpreted in accordance with applicable laws governing TicketsWale’s operations and the transaction, subject to mandatory consumer-protection laws and other legal rights that cannot be excluded.

Where applicable, Canadian federal and provincial laws may apply to transactions involving customers in Canada.

Where mandatory law provides a customer with rights that conflict with these Terms, the mandatory law will prevail to the extent of the conflict.

56. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.

The remaining provisions will remain in full force and effect.


57. NO WAIVER

Failure by TicketsWale to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.

  • Airline fare rules;

  • TicketsWale Website Disclaimer; and
  • Any additional terms expressly communicated during the booking process

constitute the agreement governing your use of the Website and Services, subject to mandatory applicable law.
